GarGeon PRIVACY POLICY

Effective Date: 09 February 2024 

Gargeon values your privacy and is committed to complying with the personal data protection laws in your country. For the purposes of this policy, “Gargeon” means GarGeon SDN BHD (Company No. 1233360-X), if you are accessing our service from Malaysia. Gargeon collects information about you when you use our mobile applications, websites, and other products and services (collectively, known as the “Services”) and through other interactions and communications you have with us.

 1.      Scope and Application

This Policy applies to persons who use our Services to schedule pickups of waste and recyclable materials by independent haulers identified by Gargeon otherwise interact with Gargeon through the Services, such as by visiting our websites or mobile applications (hereinafter referred as “User”). For purposes of this Policy, “Personal Information” includes details relating directly or indirectly to other person(s) who may be identified from the data, including but not limited to your name, age, identity card number or passport number, correspondence address, office address, gender, date of birth, contact information, e-mail address, mobile number, house number, facsimile number, and office number. 

This policy does not apply to :

(i) Information we collect from or about the third party, independent hauling companies that are (or will be) under contract with Gargeon (hereinafter referred as “Haulers”); (ii) Information collected by or any third party for that third party’s own purposes, including any content that may link to or be accessible through our services; (iii) If you interact with the service as both a User and a Hauler, the respective Policies apply to your different interactions.

 

2. Updates to the Policy 

We may update this Policy from time to time. If we make significant changes in the way we treat your personal information we will provide you with notice through the service or by some other means, such as email or posting a revised version of the Policy on our website. We encourage you to periodically review the Policy for the latest information on our privacy practices.

 

3. Sources of Personal Information 

a.) Information you provide to us We collect information from you when you directly provide it to us in the course of dealing with us. 

b.) Information we automatically collect When you use our services, we may automatically collect information about you. 

i)   Location information: when you use the service to schedule a pickup, we may collect precise location data about the pickup location.

ii) Transaction information: we collect transaction details related to your use of our services, including the type of pickup requested, date and time the pickup was provided, amount charged, weight and substance of the pickup, and other related transaction details.

iii) Usage and Preference Information: We may automatically collect information about how you interact with your service, your preference, and settings. In some cases, we do this through the use of cookies, beacons, and similar technologies that create and maintain unique identifiers.

iv) Device information: we may automatically collect information about your device, including, for example, the hardware model, operating system and version, software and file names and versions, unique device identifier, advertising identifiers, device motion information, and mobile network information.

v) Call and SMS Data: We may be required to call or text (SMS) you during your use of the services. In connection with doing so, we receive call data, including the date and time for the call and SMS message, your phone numbers and the content of the SMS message.

vi) Log information: when you interact with the service, we automatically collect server logs, which may include information like device IP address, access dates and times, app features or pages viewed, app crashes and other system activity, type of browser, and the third-party site or service you were using before interacting with our service, if you are linking to our service from such third-party site or service.

 

4.) Our use of your information 

      We may use the information we collect about you to: 

i) Provie, maintain, and improve our services

ii) Personalise and improve the services, including to provide or recommend features, content and advertisements

iii) Facilitate pickups between you and a Hauler, including to provide estimated times of arrival

iv) Send you communications we think will be of interest to you, including information about products, services, promotions, news, and events of Gargeon and third parties, where permissible and according to the Personal Data Protection Act 2010 (“PDPA”)

v) Perform internal operations, including, for example, to prevent fraud and abuse of our service; to troubleshoot software bugs and operational problems, to conduct data analysis, testing and research; and to monitor and analyze usage and activity trends

vi) Respond to your inquiries and for other customer service purposes.

 

5.) Sharing of Information 

A. We may share your personal information:

1) With Haulers to enable them to provide the service you request. For instance, we share your name and pickup location with Haulers. 

2) We will not share information with Haulers other than as necessary for them to perform the service for you

i) With other people if directed by you

ii) With third parties to provide you a service you requested through a partnership or promotional offering made by a third party or us

iii)  With the general public if you submit content in a public forum, such as blog comments, social media posts, or other features of our services that we are viewable by the general public

iv) With third parties with whom you choose to let us share information, for example other apps or websites that integrate with our API or services, or those with an API or service with which we integrate

v)With employer, if you request the service on behalf of your employer 

B. Other Sharing 

As and when necessary, we may share and/or disclose the information that we collect about you, including your Personal Data, as follows: 

(i)  INFORMATION DISCLOSED TO PROTECT US AND OTHERS

We may disclose your Personal Data to prevent an emergency, protect or enforce our rights, enforce our Terms of Use and/or to protect the safety of users of our our services or protect or enforce the rights of a third party, or as required by law.

(ii) INFORMATION DISCLOSED TO THIRD PARTY SERVICE PROVIDERS AND BUSINESS PARTNERS 

We may contract with various third parties for the provision and maintenance of the Product, Services and our business operations, and Gargeon may need to share your Personal Data and data generated by cookies and aggregate information (collectively, “information”) with these vendors and service agencies. For example, we may provide your information to a credit card processing company to process your payment. The vendors and service agencies will not receive any right to use your Personal Data beyond what is necessary to perform its obligations to provide the Services to you. If you complete a survey, we also may share your information with the survey provider; if we offer a survey in conjunction with another entity, we also will disclose the results to that entity. 

(iii) DISCLOSURE TO NON-AFFILIATED THIRD PARTIES IN FURTHERANCE OF YOUR REQUEST 

Your request for services may be shared with third party Products with whom we have a contractual relationship in order to provide your request with maximum exposure. The post on the third-party Product will include the details of your request, including your location, but will not include your last name. Interested bidders, however, will be able to click on your request on such third-party site, and will be directed to our Product where they will have access to your first name and the first letter of your last name, as would any other service provider on our Product interested in bidding on your request. 

(iv) INFORMATION DISCLOSED TO LAW ENFORCEMENT OR GOVERNMENT OFFICIALS 

We will disclose your information, including, without limitation, your name, city, state, telephone number, email address, user ID history, quoting and listing history, and fraud complaints, to law enforcement or other government officials if we are required to do so by law, regulation or other government authority or otherwise in cooperation with an investigation of a governmental authority. 

(v) IN THE EVENT OF A CHANGE OF CONTROL OR BANKRUPTCY 

In the event that Gargeon undergoes a change in control, including, without limitation, a merger or sale of all or substantially all of Gargeon’s assets to which this service relates or other corporate reorganization in which Gargeon participates, and is thus merged with or acquired by a third-party entity (a “Successor”), Gargeon hereby reserves the right to transfer the information we have collected from the users of the services to such Successor. 

In addition, in the event of Gargeon’s bankruptcy, reorganization, receivership, or assignment for the benefit of creditors, or the application or laws or equitable principles affecting creditors’ rights generally, Gargeon may not be able to control how your information is transferred, used, or treated and reserves the right to transfer the information we have collected from the users of the Product and/or Services to non-affiliated third parties in such event. 

(vi) INFORMATION DISCLOSED AT YOUR REQUEST 

We may share your Personal Data with other Registered Users to whom you explicitly ask us to send your information or if you explicitly consent to such disclosure upon receipt of a specific Service. For instance, when you contract for a specific Service with another Registered User, Gargeon will send that Registered User a notice that includes the Personal Data that you have chosen to allow Gargeon to reveal to users with whom you contract. 

6.) Analytics and advertising services provided by others

We may allow third parties to provide audience measurement and analytics services to us, to serve advertisements on our behalf across the Internet, and to tract and report on the performance of those advertisements.  

7.) Promotional communications

You may opt out of receiving promotional messages from us by following the instructions in these messages. Please allow us a reasonable period of time in order to satisfy you request, as some promotions may already be in process.
